What to do when you buy a lemon.

No matter what brand of new car you buy, there’s always the chance you’ll end up with a ‘lemon.’ What is a ‘lemon car’ exactly? Well, generally it’s one that needs excessive repairs while still new. Car’s referred to as lemons generally have persistent mechanical problems which either defy attempts at repair or simply return a period of time after each attempt to resolve the problem.
Luckily there is recourse for those new car buyers who end up with lemons. While each state’s regulations vary, every state in the USA has a lemon law of some sort. This is in place to protect consumers as buying a lemon car can be an extremely frustrating experience, and without some incentive manufacturers often aren’t much help.
So how do you determine if your car qualifies as a lemon? You should do some online research to discover what the laws are in your state. A certain number of repair attempts by the dealer for the same mechanical problem are likely going to be required. This may be exasperating for a new car owner who simply wants to enjoy their purchase but the more you follow the rules the more likely you’ll be able to use the law to your advantage.
Some manufacturers have arbitration processes in place which you may be required to use as an attempt to resolve the issue. Generally you’ll meet with a representative from the car manufacturer and an independent arbitrator. You will have a chance to state your case, provide documentation and if possibly demonstrate the defect to the arbitrator.
If this fails, your next option is usually to find an attorney to represent you in pursuing recourse via the lemon law in court. Be sure to determine what sort of cost will be associated with the lawyer representing you and if you can ask the manufacturer to pay your attorney fees.
Just remember, if you end up with a lemon, don’t just try and make lemonade or give up. The manufacturer has a legal responsibility to buy back cars which are excessively problematic
